General information on the processing of personal data

The Moravian Philharmonic Orchestra Olomouc, a contributory organisation, processes personal data in accordance with the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation or GDPR).

The Moravian Philharmonic Orchestra Olomouc, a contributory organisation, is the controller (and in some cases the processor) of your personal data.

Purpose of processing personal data

The Moravian Philharmonic Orchestra Olomouc, a contributory organization, as the controller of personal data, processes personal data mainly for the following purposes:

a) organising musical and vocal performances for the public,
b) the performance of contractual relations,
c) communication with subscribers.

Legal basis for the processing of personal data

Personal data is collected and further processed if the processing is necessary:

  • For the performance of a contract concluded between the Moravian Philharmonic Orchestra Olomouc and the subjects of personal data or for the implementation of measures taken prior to the conclusion of the contract,
  • To comply with legal obligations to which the Moravian Philharmonic Olomouc is subject.

In exceptional cases, personal data are collected and further processed on the basis of the consent of the data subjects, which always expresses the free, specific, informed and unambiguous expression of the data subject’s will and which always includes information about the possibility to withdraw the consent at any time.

Further information

Personal data shall not be transmitted to recipients of personal data unless the obligation to transmit them to authorities, bodies or institutions is imposed on the controller by a specific legal regulation or the data subject has given his/her consent.

The controller does not transfer personal data to third countries or international organisations.

The processing of personal data by the controller does not involve automated decision-making, on the basis of which actions or decisions are taken that would interfere with the rights or legitimate interests of data subjects. Profiling is not used by the controller.

Personal data are processed only to the extent necessary and for the necessary period of time, which are individual for each processing purpose. After the expiry of the necessary period, the personal data are destroyed or are further stored for the period specified in the valid Filing and Shredding Plan issued in accordance with Act No. 499/2004 Coll., on archiving and filing services.

In connection with the processing of personal data, the data subject has the right to access his/her personal data, to have them corrected or deleted, or to restrict processing, to object to their processing, to request information about the recipients, or to exercise the right to data portability and other rights under the GDPR. The data subject’s requests will always be properly assessed and dealt with in accordance with the relevant provisions of the GDPR. The data subject also has the right to lodge a complaint with the Data Protection Authority.

Where the processing of personal data is based on the performance of legal obligations and the provision of personal data is a legal requirement, the data subject is obliged to provide the personal data. Failure to provide personal data may result in the failure to comply with the legal requirements, which may lead to the frustration of the actions carried out. Where the provision of personal data is a contractual requirement or a requirement that must be included in a contract (and is not in fulfilment of a legal obligation), a refusal by the data subject to provide personal data may result in a situation where the contract cannot be concluded. However, the controller does not make the conclusion of a contract conditional on the provision of personal data by the data subject which are not necessary for the proper conclusion of the contract.

Data Protection Officer

The Moravian Philharmonic Orchestra Olomouc, a contributory organisation, has appointed a data protection officer to carry out the tasks under Article 39 of the General Regulation and to be your contact person for dealing with your enquiries, requests or applications.

Your requests will always be properly assessed and dealt with in accordance with the relevant provisions of the GDPR. If you do not agree with the handling of your requests and enquiries, you have the right to lodge a complaint with the Data Protection Authority.
